Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Famula service, including the famula.ai website and any related applications, APIs, and features (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Famula provides software that helps you automate workflows by executing tasks on your behalf according to instructions you provide. The Service produces outputs based on those instructions, and you remain solely responsible for the instructions you give and the actions you take in reliance on any output.
We may change, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to notify you of material changes that affect your use of the Service.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information when creating an account and to keep your credentials secure. You are responsible for all activity that occurs under your account.
3. Your Instructions and Connected Services
You may direct Famula to connect to third-party services (such as email, calendar, or other accounts you control). By connecting a third-party service, you authorize Famula to access and act on that service on your behalf, within the scope you grant. You are responsible for ensuring you have the right to connect those services and for complying with their terms.
Any action the Service takes at your direction, including any action taken through a third-party service you have connected, is your action. You are solely responsible for what you instruct the Service to do, for the consequences of those instructions, and for any communications, transactions, or changes that result. This is true whether the instructions are provided directly by you, by someone you authorize, or through settings, goals, or rules you configure in the Service.
You are responsible for reviewing any output the Service produces before relying on it or allowing it to take effect, particularly for decisions with financial, legal, medical, employment, safety, or similar consequences. Outputs may be incomplete, inaccurate, or unexpected, and the Service is not a substitute for professional judgment or advice. You use the Service at your own risk.
4. Acceptable Use
You agree not to use the Service to:
- violate any law or the rights of others;
- send spam, harass others, impersonate any person, or distribute malicious code;
- attempt to access the Service or its systems in any way other than through the interfaces we provide;
- reverse engineer, scrape, or copy the Service except as permitted by law;
- use the Service to make decisions that would require a licensed professional without involving a qualified professional.
5. Fees, Trial, and Cancellation
Famula may offer a free trial. After the trial, the Service is provided on a subscription basis at the rate shown when you sign up. Subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Unless required by law, fees already paid are not refundable.
6. Your Content
You retain ownership of the content and data you submit to the Service. You grant Famula a limited license to use that content solely to operate, secure, and improve the Service for you. You represent that you have all rights necessary to submit your content and to authorize Famula to act on it.
7. No Warranties
The Service is provided as is and as available, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted or error-free. We do not warrant that any output will be accurate, complete, or suitable for your purposes.
8. Limitation of Liability
You use the Service at your own risk and assume all responsibility for your use of it and for the consequences of any instructions you give the Service.
To the fullest extent permitted by applicable law, Famula and its owners, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, whether or not we have been advised of the possibility of such damages, and regardless of the theory of liability.
To the fullest extent permitted by applicable law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the lesser of (a) fifty U.S. dollars ($50) or (b) the amounts you paid to Famula for the Service in the one (1) month before the event giving rise to the liability.
The exclusions and limitations in these Terms apply to the maximum extent permitted by applicable law and do not apply where such exclusion or limitation is prohibited by applicable law. Nothing in these Terms is intended to limit any liability that cannot be excluded or limited under applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Famula and its owners, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your content or instructions, (c) your connected services or accounts, or (d) your violation of these Terms or any law or third-party right.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. The sections that by their nature should survive termination will survive.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in the Service). Your continued use of the Service after the changes take effect means you accept the updated Terms.
